Pausing FCPA Enforcement: An Analysis of the Road Ahead and What Lies Ahead for Legal & Compliance Professionals

AMCHAM’s Ethics & Compliance Committee, on February 20th, organized a virtual interaction with Mr. Sherbir Panag, Founder & Managing Partner of Panag & Babu Law Offices, to discuss the recent executive order on pausing FCPA enforcement and its impact on the future of legal and compliance work. Mr. Gaurav Ajmani, Chairperson – Ethics & Compliance Committee, AMCHAM and Associate General Counsel: Business Conduct & Ethics, Amazon, Ms. Bhawna Ranganadhan, Co-Chairperson – Ethics & Compliance Committee, AMCHAM and Sr. VP & Deputy General Counsel, Legal and Compliance, Genpact and Ms. Piya Haldar, Co-Chairperson – Ethics & Compliance Committee, AMCHAM and Chief Compliance Officer, Honeywell India moderated the discussion. The session explored the impact of the recent executive order on the business operations of U.S. organizations in India, future of FCPA, emerging risk areas, changing role of the compliance function and the Indian enforcement ecosystem. More than 80 members participated in the discussion with questions ranging from impact on trade, GCCs and DEI, effects on ABC, PCA an UKBA, extent of EO, certifications, trainings, challenges, etc.
