Recommendations on Draft Regulations for Use of Artificial Intelligence in Courts, 2026

AMCHAM submitted suggestions to the Supreme Court of India on the Draft Regulations for Use of Artificial Intelligence (AI) in Courts, 2026. The recommendations cover a risk-tiered classification framework calibrated to use case and influence on judicial outcomes, clearer definitions of “AI” and “AI Service Provider” with responsibility allocated across the value chain, recognition of independent certifications and assurance frameworks without disclosure of proprietary source code or datasets, disclosure obligations focused on AI use materially affecting legal analysis or case outcomes, and a technology-neutral approach to deployment, and data aligned with the DPDP Act, 2023 while preserving IP, confidentiality and legal privilege.
